RuskiReklama Terms of Use

1. Introduction and Definitions

According to Turkish law experts, Terms of Use for a digital platform define the framework of the service and the obligations of both the provider and users. By accessing or using RuskiReklama ("Site" or "Platform"), you ("User") agree to be bound by these Terms, our Privacy Policy, and other agreements governing your use of the service. RuskiReklama, Inc. ("Company" or "we") provides a news and classifieds platform. We may change these Terms at any time (and will update published Terms accordingly). It is your responsibility to periodically review these Terms; continued use of the Site means acceptance of updates. Under Turkish law, websites must comply with the Personal Data Protection Law (KVKK), so our privacy practices follow KVKK requirements.

"User" means anyone who accesses the Site. "Prohibited Content" refers to items or posts prohibited under our policy (see Section 5). 2. Platform Services

RuskiReklama is an online platform providing news, community listings, classifieds, and advertising services to connect users in Turkey. Through the Site and our mobile app, Users may post and view listings (e.g., for jobs, real estate, goods, and services), review local yellow pages and listings, read news articles, and participate in community forums. The Company provides this service "as is" and is not a party to transactions between Users. Users select any goods or services at their own risk; we are not involved in negotiating or fulfilling any contract between Users. We do not verify or guarantee the quality of any item or service offered by Users. Users are responsible for evaluating another user or transaction and complying with applicable laws.

User Content License: By submitting Content to RuskiReklama, you grant us a perpetual, irrevocable, worldwide, royalty-free, and sublicensable license to use, reproduce, modify, publish, translate, create derivative works from, and distribute your Content in connection with operating and promoting the Platform. You retain ownership of your Content but agree it may be used for site operation, promotion, or publication.
User License from Platform: In return, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site in accordance with these Terms. You may not reproduce, adapt, distribute, or commercialize any part of the Site's proprietary design or content without our permission.

3. Registration and User Accounts

To use certain features (such as posting listings or accessing account-specific content), you must register for a user account. You agree that your registration information will be accurate and complete and that you will keep it current. Only one account is permitted per User. You must keep your password and account credentials confidential; you are responsible for all activities under your account. If you suspect unauthorized use of your account, you must notify us immediately. We will not be liable for losses arising from someone else's use of your account, except as required by law. We reserve the right to suspend or delete accounts that are inactive or violate these Terms. If you change your email preferences, you may unsubscribe from promotional emails, but you may not unsubscribe from service-related communications (e.g., security alerts, account notifications) unless you disable your account.

4. User Content and Submission

You are solely responsible for all Content you submit to RuskiReklama. You warrant that you have all necessary rights to submit your Content and that you do not violate anyone else's rights. You declare and agree that your Content is accurate, truthful, and lawful. You may only use the Site's messaging or submission features to communicate with other Users for purposes permitted by these Terms. Your Content may be moderated, reviewed, or edited by us; we reserve the right to block, remove, or reject any Content, especially if it violates these Terms.

User Content Licensing: By submitting Content, you grant RuskiReklama the license described above and agree not to assert moral rights or other claims against us regarding this Content.
Content Ownership: Except for the license you grant us, you retain all ownership and responsibility for your Content. We do not claim ownership of your User Content. You also grant other Users a license to view your posts on the Site (e.g., a buyer viewing your listing).

5. Content Standards and Prohibited Content

All Users must comply with applicable laws and site rules. You may not post any Content that is illegal, harmful, or violates others' rights. The following categories (among others) are strictly prohibited on RuskiReklama:

Illegal or Regulated Goods/Services: Firearms, guns, or gun parts; explosives, ammunition, or reloading materials; illegal drugs or drug paraphernalia; prescription drugs without a prescription; stolen property; counterfeit or pirated products; recalled products; or any item whose sale is illegal.
Illegal Activities: Content facilitating illegal activities such as promoting violence, hate speech, terrorism, sexual exploitation (including child sexual abuse materials), prostitution, or human trafficking is prohibited.
Offensive or Fraudulent Content: Defamatory, obscene, threatening, discriminatory, or harassing posts; misrepresentations; fraudulent or deceptive offers; pyramid schemes; spam; and unsolicited promotional content are prohibited.
Privacy Violations: Personal data belonging to others (such as financial information, government IDs, confidential records) may not be posted. Sharing another person's non-public personal information without authorization is prohibited.
Prohibited Offers: Gambling, lotteries, alcohol or tobacco trade (where prohibited), or other goods/services banned by law.

Please do not attempt to circumvent these restrictions. Misleading, miscategorized, or Content primarily intended to drive traffic to third-party sites (spam) is also prohibited. In short, if a User's post violates any law or is likely to cause harm, you should not post it.

6. Submission Behavior and Usage Restrictions

You may not use automated tools (robots, spiders, scrapers, bots, scripts, etc.) to access or collect any content from the Site. You agree not to attempt to bypass measures that restrict or control access, and you will not interfere with other Users' access to the Site. You may not share or sell your account with others. Abusing Site features (e.g., flooding the system with duplicate listings or abusing reporting/flagging functions) is prohibited. We have the right to moderate all activities on the Site and to suspend or terminate access that violates these rules.

7. Account Termination and Consequences

User Termination: You may terminate your account at any time by following the instructions in your account settings or by notifying us. Upon termination, your account and personal data will be deleted from our system as described in our Privacy Policy.

Platform Termination: RuskiReklama reserves the right, in its sole discretion, to suspend or terminate your account if you violate these Terms or for any other reason (e.g., inactivity or law enforcement requests). We may delete any Content or information associated with your account and prevent your access to the Site.

After termination (by you or us), you must stop all use of Site services. If you have a paid advertisement or other paid services, termination ends these services without any refund beyond what has already been provided. Specifically, fees paid for listings or promotions are not refunded after the service is activated. When your account is deleted, all links to your content on RuskiReklama are removed. Note that Turkish law may require us to retain certain records, but otherwise your personal information is deleted according to our data retention policy.

8. Fees, Payments, and Refunds

Certain features of RuskiReklama may be offered for a fee (e.g., "featured" listings, promoted ads, or subscriptions). By purchasing any paid service, you agree to the payment terms in effect at the time of purchase. No Refunds: After a paid service is activated or delivered, no refunds will be made for poor performance or change of mind. Fees are specified in advance, and any tax is extra. You authorize charging the credit card or payment method you provide. If your payment fails, we may suspend the relevant service until payment is received.

9. Disclaimer and Limitation of Liability

Warranty Disclaimers: To the fullest extent permitted by law, RuskiReklama and its affiliates provide the Site and all Content "AS IS" and "AS AVAILABLE." We make no representations or warranties about the accuracy, reliability, completeness, or suitability of the Site or Content. We expressly disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability: We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any Content, even if we have been advised of the possibility of such damages. This includes damages for lost profit, lost data, or loss of reputation. Our total liability to you under these Terms for any claim will not exceed (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) 250 TL, except as prohibited by law. Each provision of these Terms that provides for limitation of liability is intended to allocate risks and is a fundamental element of our agreement. If any part of these limitations is deemed unenforceable, that part will be limited only to the extent necessary, and the remaining provisions will continue in effect.

As law experts recommend, comprehensive disclaimers are crucial for online platforms. Accordingly, RuskiReklama also disclaims liability for third-party content, advice, or opinions submitted by Users. You understand that any reliance on Content or interactions with other Users is at your own risk. We do not guarantee continuous, secure, or error-free access to the Site.

10. Indemnification

You agree to indemnify and hold harmless RuskiReklama and its officers, directors, employees, agents, and affiliates from any claims, demands, losses, liabilities, and expenses (including attorney fees) arising from or related to your use of the Site, your Content or posts, your violation of these Terms, or any law or third-party right. If we request, you will defend any third-party claim or demand against us related to you or your actions and bear all associated costs. This indemnification obligation continues after termination of your account or these Terms.

11. Governing Law

These Terms and your use of the Site are governed by the laws of the Republic of Turkey, regardless of conflict of law principles. Under Turkey's Consumer Protection Law (Law No. 6502), unfair terms creating an imbalance against the user may be void. Any dispute arising from or related to these Terms or your use of RuskiReklama will be subject to the exclusive jurisdiction of the courts of Istanbul. By using the Site, you consent to the venue and jurisdiction in Istanbul for any such dispute.

12. Miscellaneous and Contact Information

Severability: If any part of these Terms is deemed invalid, that part will be limited or severed only to the minimum extent necessary, and the rest of these Terms will remain in full force.
Assignment: You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may transfer our rights without restriction.
Entire Agreement: These Terms (together with the Privacy Policy and any additional guidelines or policies referenced herein) constitute the entire agreement between you and RuskiReklama regarding the Site and supersede prior agreements or understandings.
